Evictions
Before residential and commercial landlords begin the eviction process, they must take great care to follow the correct steps and not deviate from those steps.
Doing things that may seem minor, such as terminating air conditioning or turning off water, can backfire and prove costly. Having an experienced lawyer
on your side can be extremely beneficial. We will use that experience to help you with the eviction process and to help you get any back rent you are owed.
Take the First Step
Whether you want to evict a tenant for unpaid rent or for damaging property, the first step that needs to be taken is to post notice. When it comes to
overdue rent, many landlords hesitate. They want to maintain a good relationship with the tenant. However, the greater amount of past due rent that
accrues, the greater the challenge to collect. There is no reason not to post notice and file eviction paperwork as soon as a tenant falls behind
on rent. If the tenant catches up, obviously, the eviction process is no longer required.
Justice of the Peace Court
All evictions are handled in the Justice of the Peace Court. This includes residential or commerical evictions. While the rules for residential and
commercial evictions are different, they are handled in the same court. We have the experience to handle both.
Once back rent owed exceeds the jurisdiction of the court, the matter will be taken to a higher court.
While the eviction itself will remain, the collection lawsuit will need to be taken to another court. We can handle these complex eviction cases.
